What the statutes mean

You are allowed to require an employee to have a physical as a condition of employment. However, you may not require the individual to pay for the exam. This is true even if the employee resigns from the job shortly after joining your staff.

Statute excerpts

103.37(1) It shall be unlawful for any employer, as defined in sub. (3) to require any employee or applicant for employment to pay the cost of a medical examination required by the employer as a condition of employment.
